All orders that you place on the following websites: www.etalianfood.com , www.etalianfood.it , www.etalianfood.co.uk owned by ETALIAN FOOD by Penitente Carmela, will be subject to acceptance in accordance with the following Terms and Conditions.

The contract between ETALIAN FOOD and the client is considered concluded with the confirmation of the order. The order acceptance is considered silent, if not otherwise stated by the client via e-mail or in other written form. Performing a purchase, the client declares to have read and understood the information provided in the terms and conditions as well as to integrally accept all the general conditions of purchase and payment.

The client can purchase products seen on line at the following websites www.etalianfood.com , www.etalianfood.it , www.etalianfood.co.uk , as they are described in the product catalogue.  ETALIAN FOOD ensure that products delivered will be equal to those shown and described on the site and compliance with all rules regarding the storage of goods until delivery at the place specified in the order. For all products sold that is the responsibility of the producer. Manufacturer is also responsible for the accuracy and completeness of the information given on the packaging in the case of packaged goods. The images on this site are provided to the Client to facilitate the recognition of the products, due to changes in packaging by the manufacturer, the photos might not exactly reflect the appearance of the product delivered.

The indications on ingredients and allergens of the products may vary due to changes made by the producers that could temporarily cause variations between the information on the site and those reported on the products that are delivered. We therefore invite you to check the information on the product label or pack (if any) before consuming or using it.

The Customer Consumer, as art. 3 of the Italian Codice del Consumo, has right to invoke the legal guarantee provided by the Consumer Code itself Articles 128-132.

After any purchase the client will receive from ETALIAN FOOD a confirmation email to the email address provided by the client during the purchase procedures. The client must check the correctness of the data submitted and confirmation of shipment and immediately communicate any corrections, according to the methods described in this document.

In case of non acceptance of a purchase order, ETALIAN FOOD will immediately notify the client to the email provided by the client during the purchase procedures.


ETALIAN FOOD ensure that products delivered will be equal to those shown and described on the site and compliance with all rules regarding the storage of goods until delivery at the place specified in the order. As required by current rules, customers enjoy the ETALIAN FOOD money back guarantee with the ability to return products purchased within 14 days of receipt, except if they are products which by their nature can not be returned.

Return and Refund

Within 14 days of delivery , if you are not satisfied and the product has not yet been used, please send us an email at info@etalianfood.com, or a letter at EtalianFood di Penitente Carmela Via degli Agrifogli, 16-50142 Florence- Italy, or a fax 00390555121403.

In the above notification, the client must indicate the product(s) that are going to be returned, we will send anauthorization number to the withdrawal within 24 hours.

- To exercise your right to return the product(s) purchased,  they must be in good condition and with the original labels attached.

- The packaging of the products must be accurate, in order to protect the original wrapping from any damage, writing, or labeling.

- Products must be returned at customer own expense with trackable shipping method, as it  ETALIAN FOOD will not be responsible for loss, the failure to receive or damage of the material submitted.

- Refund: In accordance with art. 56 of the Consumer, reimbursement code must be made within 14 days of receipt of the cancellation notice, as required by law, stating the following:

If you withdraw from this contract, we shall reimburse all payments received from you, including the costs of delivery (except for additional costs resulting from your choice of a different type of delivery the least expensive type of standard delivery from we offer), without undue delay and in any event no later than 14 days from the day we are informed about your decision to withdraw from this contract. The redemption may be retained beyond 14 days only until you have supplied evidence of having sent back the goods or until these have not been received by us, depending on which situation occurs first. 

Decrease in value: According to the current legislation, the only exception justifying the Reduction of Refunds due to the Customer in the event of a withdrawal is the possible decrease in value of the asset, which is indicated as follows:

You are only responsible for the diminution of the value of the goods resulting from manipulation of the goods other than the one necessary to establish the nature, characteristics and operation of the goods.

In case the client decided to cancel the order or etalian food decides not to accept the order the re-credit procedure will immediately take place. The timing of the re-credit belongs to the payment method selected and to the banking system. In any case etalian food can be considered responsible for any delay of the re-credit

ETALIAN FOOD as the right to ask the client any additional information considered relevant to identify the owner of the bank account, credit card or paypal account used for the payment. Etalian food has the right to cancel the order in case the client decides not to provide etalian food the additional information required.

ETALIAN FOOD cannot be considered responsible for any fraudulent use of the credit card details of the client used to purchase items www.etalianfood.com , www.etalianfood.it , www.etalianfood.co.uk .

Delivery Costs and Procedures

EXTRA UE SHIPPING: Please note that for all shipments to the countries outside the EU the recipient has to pay VAT and possible customs duty if in force in his own country.

ETALIAN FOOD accepts purchase orders from every country unless limitations imposed by national and international laws. All deliveries are made by express courier and the costs, which are based on the weight and/or the size and/or the value of the items and the country of destination, are shown during the purchase procedures. The client will be charged for the delivery costs and possible duties. The client has also the possibility to insure the delivery at his own cost.

Upon receipt of the delivery of the items acquired the clients has to verify the following:

a. The number of the items delivered needs to be the same of the number written on the transportation form;

b. The delivery package has to be intact and well preserved.

In case the number of items delivered is not the same of the number written on the transportation form and/or in case of damages caused by the delivery the client has to immediately notify the express courier clearly specifying the reason. Once the client has signed the transportation form without notifying the delivery company for any damage or problem in relation to the package received, the client has no more the right to ask for any reimbursement in relation to the package received. Any potential problem related to the packages received needs to be notified within 7 days following the procedures specified in this document.

In case the express courier is not able to deliver the items to the client, the express courier will held the items for 5 working days in its warehouse. After 5 working days the items will be sent to etalian food warehouse in Florence – Italy. To receive the delivery the client will need to pay again the delivery cost.

Complaint and Resolving Disputes.

Every dispute has to be sent to etalian food at the following email info@etalianfood.com, otherwise according to the European Union Regulation no. 524/2013, the Consumer may exercise his right to bring the European Dispute Settlement Body, as an alternative to the ordinary court.

The Consumer Resident in Europe is informed that the European Commission has established an online platform providing an alternative dispute resolution tool.
This instrument may be used by the European Consumer to resolve any dispute relating to contracts for the sale of goods and services entered into and / or from the network on a non-judicial basis.
As a result, if you are a consumer established in Europe, you can use this platform to resolve any dispute arising out of the online agreement stipulated on this site.

The contract between ETALIAN FOOD and the client is intended to be concluded in Italy and is regulated by the Italian law.
